Promotion Agreement case study – Hill Farm, Galley Common

This comprised of a 34 acre site on the outskirts of Nuneaton and on behalf of our two landowner clients we agreed a promotion agreement with Gladman Developments Ltd. There was an opportunity for the promoter to apply for planning permission at an early stage due to the local planning authority not having a 5 year housing land supply. An application by the promoter was refused but we decided to opt for a twin track approach, whereby we would pursue an appeal on the refusal of the original application, but at the same time submit a revised application for a scheme addressing the reasons for refusal. This strategy was successful, and the promoter achieved planning permission on the basis of the revised scheme without needing to go to appeal. The site was then marketed on behalf of the two landowners and successfully sold to Taylor Wimpey. Our clients still own a second phase of development on the site which is under option to Bellway plc.
