From August 6th 2026, changes to Biodiversity Net Gain (BNG) have been implemented through new regulations under the Biodiversity Gain Requirements (Exemption) Regulations 2026.
For smaller development sites, BNG requirements have often meant additional surveys, calculations, costs and delays before work can begin. The latest update introduces an area based exemption for development sites of 0.2 hectares (2,000m²) or less, helping to reduce the administrative burden for smaller schemes.
For qualifying developments, the change can remove some of the additional cost and complexity associated with mandatory BNG. This can include the need for:
The update is expected to benefit a significant proportion of minor residential planning applications.
For smaller sites, the cost of ecological surveys and navigating the statutory biodiversity metric could sometimes be disproportionate to the scale of the development.
The new threshold is intended to help unblock local housing delivery, particularly on infill plots, small brownfield sites and small scale rural developments.
The exemption isn’t a free pass.
Protected habitats– The exemption does not apply where protected or priority habitats are present.
Other environmental rules still apply- Wider wildlife legislation, Tree Preservation Orders and local planning policies remain fully relevant.
